ARTICLE I: SCOPE OF AGENCY AND INTELLECTUAL PROPERTY. All works, including but not limited to RAW files, metadata, HDR processed imagery, cinematic 4K video, 9:16 vertical social media assets, Matterport 3D data, and schematic floor plans, are the proprietary intellectual property of BIT MEDIA 01. Licensing is granted only for the duration of the listing's active status on the MLS. Any unauthorized distribution to third-party entities is a violation of the DMCA and results in a liquidated damages fee of $5,000 per instance.
ARTICLE II: 2026 DIGITAL INTEGRITY AND AI ETHICS. BIT MEDIA 01 operates in strict adherence to the 2026 Real Estate Content Transparency Act. We do not engage in "Deceptive Retouching." AI-driven enhancements are categorized as "marketing enhancements" and do not constitute a representation of fact. Client assumes full responsibility for disclosing all digital alterations to end-users.
ARTICLE III: AERONAUTICAL OPERATIONS. Aerial capture is performed under FAA Part 107. In accordance with Florida Statute 934.50, Client warrants they have obtained express written consent from the legal property owner for BIT MEDIA 01 to enter the airspace.
ARTICLE IV: SMS PROGRAM TERMS. When you opt-in to the service, we will send you an SMS message to confirm your signup. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. For assistance, text "HELP" at any time. BIT MEDIA 01 uses SMS messaging to send booking confirmations, appointment reminders, shoot scheduling updates, and media delivery notifications to users who have explicitly opted in.
ARTICLE V: CARRIER LIABILITY DISCLAIMER. BIT MEDIA 01 is not liable for any delays or failures in the receipt of any SMS messages connected with this service. Delivery of SMS messages is subject to effective transmission from your network operator. Message delivery is not guaranteed. Mobile carriers including but not limited to AT&T, Verizon, T-Mobile, and others are not liable for delayed or undelivered messages. BIT MEDIA 01 shall not be held responsible for any losses or damages arising from non-delivery, delayed delivery, or misdirected delivery of any SMS message.
ARTICLE VI: AGE RESTRICTION. By opting in to receive SMS messages from BIT MEDIA 01 you confirm that you are 18 years of age or older. Our SMS messaging service is intended for use by adults and real estate professionals only. BIT MEDIA 01 does not knowingly collect personal information from or send SMS messages to individuals under the age of 18. If we become aware that a user is under 18, we will immediately remove them from all messaging lists. Parents or guardians who believe their minor child has opted in should contact us immediately at hello@bitmedia01.com.
ARTICLE VII: PROPERTY READINESS & ACCESS. Subject property must be "Shooting-Ready" upon arrival. Failure to provide site access within 15 minutes of the scheduled time constitutes a breach of contract, resulting in a 100% service fee charge plus a $50 travel surcharge.
ARTICLE VIII: LIMITATION OF LIABILITY. The maximum aggregate liability of BIT MEDIA 01 shall be limited to the total amount actually paid by the Client for the specific project. All media is provided "as-is" with no warranties, express or implied. BIT MEDIA 01 shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or SMS communications.
ARTICLE IX: FINANCIAL TERMS. Payment is due in full prior to the release of high-resolution digital assets. BIT MEDIA 01 reserves the legal right to file a mechanic's lien against the subject property for any unpaid balances exceeding 30 days. All sales are final.
ARTICLE X: DATA PRIVACY AND SMS OPT-IN DATA. BIT MEDIA 01 does not sell, rent, share, or transfer your personal information or SMS opt-in data to any third parties for marketing purposes. Your phone number and contact information are used solely to deliver the services you have requested. SMS opt-in information will never be shared with third parties or affiliates for their own marketing use. For full details on how we collect and protect your data, please see our Privacy Policy.
ARTICLE XI: CANCELLATION AND RESCHEDULING. Cancellations made less than 24 hours before a scheduled shoot are subject to a 50% cancellation fee. Rescheduling requests made less than 24 hours before the shoot are subject to a $50 rescheduling fee. BIT MEDIA 01 reserves the right to reschedule any shoot due to weather conditions or circumstances beyond our control at no charge to the client.

ARTICLE XIII: GOVERNING LAW. This agreement shall be governed by the laws of the State of Florida. Any disputes shall be settled exclusively in the courts of Hillsborough County, Florida. Both parties waive their right to a jury trial.
